Terms of Service

1. Eligibility

You must be at least 18 years old and competent to enter into a contract under the Indian Contract Act, 1872 to use the Service. By using the Service you represent that you are using it for a lawful business purpose in India.

2. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@ownit4u.in if you suspect any unauthorised access. We may suspend or terminate accounts that we believe are being used in breach of these Terms.

3. Subscription and free trial

OwnIt offers a 30-day free trial. After the trial, continued access requires a paid subscription. Subscription plans, prices and inclusions are described on our pricing page and may change from time to time. Any change will apply only to subsequent billing cycles.

4. Payments

Subscription fees are collected in Indian Rupees through our payment partner Razorpay Software Private Limited. By making a payment you also agree to Razorpay's terms and privacy policy. We do not store your full card or banking details on our servers. Applicable Goods and Services Tax (GST) will be added where required by law.

5. Cancellation and refund

You may cancel your subscription at any time from inside the app or by writing to contact@ownit4u.in. On cancellation, your subscription will remain active until the end of the billing period already paid for and will not renew thereafter.

Because OwnIt is a digital service delivered immediately on payment, subscription fees are generally non-refundable. However, if you believe you were wrongly charged, please raise the matter with us within 7 days of the charge. We will investigate in good faith and, where the claim is found valid, issue a refund to your original payment method within 7-10 working days.

6. Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent or misleading purpose;
• upload or transmit viruses, malicious code or content that infringes the rights of others;
• attempt to gain unauthorised access to the Service or its related systems;
• use the Service to send unsolicited communications in violation of applicable law;
• resell, sublicense or commercially exploit the Service without our written consent.

7. Your data

You retain ownership of all business data you enter into the Service (such as customer details, invoices, inventory and udhaar records). You grant us a limited licence to host and process this data solely to operate the Service for you. Our handling of personal data is described in our Privacy Policy.

8. Service availability

We work hard to keep OwnIt available 24x7 but do not guarantee uninterrupted access. Planned maintenance, third-party outages or events beyond our reasonable control may occasionally affect availability. We will, where practicable, give advance notice of planned downtime.

9. Intellectual property

All rights, title and interest in the OwnIt brand, software, designs and content remain with us. These Terms do not transfer any of our intellectual property to you, other than the limited right to use the Service while your subscription is active.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service shall not exceed the subscription fees you paid to us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential losses, including loss of profits or business data.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms or if required by law. On termination, you may export your data for a reasonable period before it is deleted from our active systems.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal.
